Why
do I need a lawyer?
The
Workers' Compensation laws are heavily weighted in favor of the employer/insurance
company and self-insured/servicing agents. (The old adage, "What is
good for business is good for Georgia" does not address the needs of
the injured worker).
- There
is a constant and deep tension between the injured worker and the employer.
It seems that as soon as the worker sustains an injury, the employer
and insurance company look with distrust upon the injured person as
though the accident took place deliberately!
- Many insurance
lawyers are giving advice to the employers, insurance companies and
third party administrators "behind the scenes" without you knowing it.
Who gives you advice? Your next-door neighbor or relative who may have
had one injury claim or may know of a person who has had a claim at
some time in the past? The insurance adjusters will never make you aware
of all of the benefits to which you may be entitled (I know, I was an
adjuster!); and,
- Most injured
workers have never had but one claim in their lives and that is their
current claim. Most insurance adjusters handle 300 cases on a regular
basis and have much more experience than you. Most claims become complicated
quickly. Without experience, you are no match for the adjustor and insurance
company lawyer.
- Do you
realize that many doctors who treat the injured workers are bought and
paid for by the employers, insurance companies and servicing agents?
Many of these doctors have undisclosed agreements with the companies
they work for that they will not refer the injured worker to a specialized
physician unless the adjuster intervenes and makes the referral and
chooses the specialized physician. The expression that I use all of
the time is "the person who controls the doctor controls the case".
