Do
I represent everyone who has been injured or is disabled?
No I do not. I will give you my best advice by telephone based on the
information you present to me. If you do not need a lawyer, I will tell
you so.
Will
you or your office staff handle my case?
Many high volume practices (TV lawyers) will have "Paralegals" or secretaries
handle your case. I do have office staff and assistants who work with
me. However, I make every decision regarding your case at every turn.
When
should I settle my case?
Generally, only when you have completed a course of medical care and where
no further surgery is needed or desired. Follow-up care that may be needed
after surgery can still allow you to settle with the care provided by
the insurance company for a year or less. If you need more time than this,
you should not settle.
Will
you pressure me to settle my case like most lawyers do?
Absolutely not. Even though you may be pressured by an attorney to settle,
you have no obligation to do so. In fact, the employer/insurer is not
required to settle any claim either. In Georgia, settlement occurs only
when all parties agree to do so. No party can be forced to settle by going
to court.
Can I
terminate your legal services if I do not like what you are doing for
me?
Yes. You can send me a letter stating you are firing me. One sentence
is all you need to write. If I have performed genuine legal work on your
case and obtained benefits for you, I will be entitled to a payment based
upon an hourly rate once I document my services but only at the end of
your case. However, the attorney fee must be paid by your next lawyer,
not by you. You are required to pay no more than 25% of any settlement
no matter how many lawyers you have hired throughout the course of your
claim.
